Impounds, Accidents, Private Property Tow-a-Ways

Local police agencies and the Louisiana State Police may request a vehicle be towed or impounded for any number of reasons. Examples include accidents, DUIs, arrests, no insurance violations, etc. These tows are defined by the Louisiana Public Service Commission as Non-Consensual tows or regulated tows. Other examples of Non-Consensual tows are vehicles parked without authorization or abandoned on private property. As these tows are defined as Non-Consensual, the State of Louisiana has mandated that the Louisiana Public Service Commission protect the public by regulating the prices charged for these tows.

SCHEDULE OF PRESCRIBED RATES AND REQUIREMENTS FOR TOWING & RECOVERY

In the event your tow is regulated or non-consensual, the following notice will appear on your invoice. You will be required to sign acknowledgment that you have received this notice and are aware of its content.

IMPORTANT NOTICE: This regulated towing and recovery by ASAP Towing & Road Service has been designated as a non-consensual tow. ASAP Towing is required to charge rates set by Louisiana Public Service Commission orders. These rates may be found on the Internet by accessing www.lpsc.org or by contacting the Louisiana Public Service Commission, Transportation Division at 1-888-342-5717. If you have a complaint against this towing company regarding the amount charged for this non-consensual tow, complaints should be made in writing and addressed to PO Box 91154, Baton Rouge, Louisiana 70821 or by contacting a District Commissioner.

Recovering Your Vehicle

Towers in the State of Louisiana are bound by the laws written into Louisiana Title 55 where it concerns releasing a vehicle towed under the definition of a Non-Consensual Tow.

“Vehicles shall be released immediately to the vehicle
owner or lien holder, or authorized agent once payment is
made, any applicable lien holder requirements
(R.S. 32:1720.1) are met, and any applicable documented law
enforcement or department hold orders are released.”

For clarification,

OWNER – the last registered owner of a vehicle as shown on the records of the Office of Motor Vehicles and/or the holder of any lien on a vehicle as shown on the records of the Office of Motor Vehicles and/or any other person who has a documented ownership interest in a vehicle. Documented proof of ownership shall include a title, current registration or notarized bill of sale.

In the event a vehicle is owned by a company or corporation, the person removing the vehicle or items from the vehicle will be required to show company affiliation. Such documentation may include Articles of Incorporation from the Secretary of State or other forms deemed sufficient to prove a persons right to remove the vehicle or articles from the vehicle.

In the event a vehicle in operable condition is to be removed from storage, valid proof of liability insurance as required by the State of Louisiana will be required as will a licensed driver.

If the Registered Owner is Not Available

In the event the vehicles registered or titled owner is not available to retrieve the vehicle or personal property from the vehicle, written authorization may be given to a proxy by filling out . The form the Proxy Authorization Form found at this link may be faxed back to ASAP at the fax number on the form, or the designee may bring the form with them. The form must be filled out in its entirety. A legible copy of the registered owner’s drivers license or photo ID, as well as the registration or title, and proof of liability insurance, must also accompany the form. NO EXCEPTIONS. Recovering Personal Property From a Vehicle

Towers in the State of Louisiana are bound by the laws written into Louisiana Title 55 where it concerns releasing personal property from a vehicle towed under the definition of a Non-Consensual Tow.

Removable personal items shall not be withheld by the towing or storage facility. Any person with picture identification, who shows proof of ownership, or written authorization from the stored vehicle’s registered or legal owner, may inspect, photograph, view the vehicle and remove non-affixed personal property, including the license plate, without charge during normal business hours. These items will be released to the owner or person authorized by the vehicle owner upon request if there is no police hold on them.

Personal items are defined as purses, wallets, book bags, personal computers, cell phones, shoes and clothing, book bags, suit cases, tools, fishing equipment, sports equipment, etc.

Any item affixed to a car or truck, MAY NOT BE REMOVED. Any item wired to, bolted to, taped to, or in any other manner, permanently attached to the vehicle may not be removed. Examples of items which MAY NOT BE REMOVED include but are not limited to; radios, stereos, amplifiers, speakers (including sub-woofer boxes), CB radios, antennae, televisions or monitors, any rims and/or tires, body modifications or customizations, in-bed tool boxes, camper shells, batteries, engine modifications, tuners, etc. If you have any questions or concerns, please contact the ASAP dispatch center at 985-643-ASAP (2727).

No Insurance Impounds
NOV’s, Notices of Violation

In the event your vehicle was towed for a no liability insurance violation, your license plate has been removed by the police agency ordering the tow/impound. In addition you (should) have been issued a Notice of Violation, aka an NOV. You MUST bring the Notice of Violation AND current proof of insurance to the Department of Motor Vehicles. The DMV will provide you with a numbered Authorization to Release form which you MUST provide to ASAP in order to retrieve your vehicle. You MUST provide this form in addition to the registration, proof of insurance, drivers license or picture ID. There is absolutely no point in contacting ASAP until the Authorization to Release form has been obtained from the Department of Motor Vehicles. Private Property Impound Tow-a-Ways

A PPI, or Private Property Impound Tow-a-Way, is a tow requested by a private property owner or manager when a vehicle has been parked without consent or authorization. These may include vehicles parked in handicapped designated parking spots, fire zones, loading zones, tenant parking only, private driveways, etc. Vehicles towed for parking or trespass violations are reported to the police agency within which the vehicle is parked. The vehicle is verified to not be stolen and placed in secured storage as is any other impound. The same rules apply for the release of the vehicle, and the vehicle owner is responsible for the tow charges… NOT THE PROPERTY OWNER.

If you are a property owner or manager, you may request a Private Property Impound or Tow-a-Way by submitting the PPI Form found at this link. Please follow all of the directions on the form completely and fax back to ASAP. Please understand that while the inconvenience of a vehicle parked without consent or abandoned on your property is important to us, accident calls and calls for highway breakdowns do take a priority over PPI’s.
